Default what counts as a sample

i read somewhere that the actual law involving samples says that a sampl is "a substantial, fully recognisable part of a song"......

so does that mean if i take single drumbeats, hi hats and so on from tunes i dont need to clear samples? would that also apply to single notes?

No but most peeps don't make there own drum sounds (they're normally nicked off tunes or off copyright free sample CDs or web sites) It's like musical mob clamin 2 have made dat clap sound.. hmm like has any1 ever heard a 808 or 909 clap sound b4?

Just make ya own sounds mate.. layer sounds n b original Just b careful if u do sample cos u don't want a court case gettin in the way of tunage writin time.

thing is, i'm fairly new to producing... so how would i go about makeing, say, my own kickdrum if i dont have a drumkit? surely the only way is to nick them off somewhere?

surely there couldnt be a big courtcase just coz a snare was sampled off something? or a single xylophone note?

it is basic and soundforge is required. the type of bd they are talkin about isnt really dark. so dont get your hopes up. but it gives u a good idea of how to do dem.. to get good 1's u need hardware

Individual kicks, snares, hats etc. don't count as samples as such... people regularly sample these and because of their amiguous nature it'd be impossible to prove that they were taken.

However, a musical loop or vocals which contain a recognisable part of a song constitute a sample - as you said above. Just use your common sense but I wouldn't worry too much, if your just planning to release a garage white label then no one is likely to come chasing for one sample.

Someone made a 4.18min track of silence and someone else made one not knowing it had been done before and there was a big court case LMAO.

Now I think theyre tryna split hairs by saying the second version had "background noise" or some $$$$. LMAO

Yer, a classical tune did this bit where u can't hear hardly anything but just da fingerin of the playin of a pipe instrument, I think it was.. dat pop classical group.. wats their name again? Planets or something like dat, did da same ting n got sued.. so just b careful cos people r greedy n as we become more like da US, da more people will sue, u get me
